§ 7(4) Federal Leave Act (BUrlG): leave that can no longer be taken because the employment ends must be paid out. Daily rate under § 11(1) BUrlG: average pay of the last 13 weeks before the end (without overtime pay) ÷ number of working days in those 13 weeks (65 with a 5-day week). With a fixed monthly salary, 13 weeks ≈ 3 months. The payout is taxed as a one-off payment (sonstiger Bezug) and is subject to social security.
